The following terms as used and interpreted herein mean as follows:
1-1 "Organization" means C.A.O (Civil Aviation Organization)
1-2 "Control Office" means General Department of Control/Supervision on Air Transportation Companies/Airlines and Airport Services.
1-3 "Legal Office" means General Department of Air International and Domestic Flight Services.
1-4 "Charter flights"(Rent exclusively): means those flights on which the whole or partial capacity of an aircraft for domestic or international flight routes within a specified term (flight term) shall be chartered and allocated to the charter assignee/lessee.
1-5 "Charter assignee/lessee": means a real party or legal entity possessing the necessary conditions to conclude a charter contract.
1-6 "Charter assignor/owner": means Iran Air tour Airline Co.
1-7 "Charter contract": means the contract made between charter assignor and charter assignee in order to rent the whole or partial capacity of an aircraft within a specified term (flight term) for a domestic or international flight route only executable on provisions and conditions of this instruction.
1-8 "Manifest" (voyage manifesto): is list of passengers' names on the charter flight including those information related to flight route, time, date, origin and destination countries, flight number and tickets number.
1-9 "Flight license": means a permit/license issued by General Department of Supervision and Control on Air Transportation Companies/Airlines entitled to utilize a certain flight route.
Note: Any real party or legal entity may conclude a charter lease agreement to Iran Air Tour Airline Co. to rent the whole or partial capacity of flight in conformity to the conditions and regulations.
2-Assignment conditions of charter flights
2-1 The Charter assignee shall obtain the permit/license indicated in "Para.A" to receive ticket of Iran Air Tour Airline Co.
Note: Iran Air Tour ticket issued for the charter assignees the permit/license indicated in "Para.B" or "Para.P".
2-2 The adjusted manifest by the charter assignee must be issued in accordance with the flight coupons and delivered to Iran Air Tour Airline Co. before flight.
3-Duties and responsibilities of the charter assignee/lessee
3-1 The Charter assignee/lessee may transfer partial capacity of aircraft to other parties, providing that obtaining written approval of the charter assignor.
3-2 Re-assignment of the chartered capacity of aircraft to another real party or legal entity shall not be released responsibilities of the charter assignee/lessee in lieu of the charter assignor & such re-assignments may not eliminate responsibilities of charter assignee/lessee.
3-3 If the charter assignee submits any document under any title to the people without obtaining necessary permit issued by the supervision and control office and without concluding contract to the charter assignor, it shall be deemed its violation and breach of obligations, so the case refers to the technical committee or judicial authorities immediately in order to be cleared status of continuing its activity.
Note: The charter assignee shall not be entitled to settle people at airport without obtaining necessary permits as well as concluding contract to Iran Airtour Airline Co.
3-4 The charter assignee must submit its written request to Deputy of Business Department of Iran AirTour Airline Co. at least one month before.
4-Indemnification of damages on cancellation of charter flights
4-1 Any request to cancel flight as well as determining time and occurred damages in this respect shall be advised by fax massage.
4-2 If the applicant requests to cancel seat of flight or flights as the subject-matter of the contract by a written notice, the applicant shall pay the following fines, indemnify and compensate damages of Iran Airtour Airline Co. as follows:
a)10% of expenses of any cancelled flight as compensation of the occurred damages shall be paid to Iran Airtour Airline Co. until one week before flying.
b)40% of expenses of any cancelled flight as compensation of the occurred damages shall be paid to Iran Airtour Airline Co. until 72 hours before flying.
C)60% of expenses of any cancelled flight as compensation of the occurred damages shall be paid to Iran Airtour Airline Co. until 48 hours before flying.
D)80% of expenses of any cancelled flight as compensation of the occurred damages shall be paid to Iran Airtour Airline Co. less than 48 hours before flying.
4-3 In case of non-indemnification of the foregoing damages, the Company shall be entitled to collect its demands and claims for compensation of the occurred damages and deduct them from the security deposit amount, guaranties or other financial sources.
